Workers' Compensation

Most of the attorneys in the workers' compensation practice group at Troubh Heisler have worked together for approximately twenty years. We have long represented many of the state's largest employers and insurers in controversies relating to workers' compensation law. Our attorneys have the expertise and experience necessary to protect the interests of our clients facing claims under the Maine Workers' Compensation Act and the U.S. Longshore and Harbor Workers' Compensation Act. The firm also represents employers and insurers in proceedings involving insurance regulatory and rate issues.

Our workers' compensation attorneys have lived through all of the major changes in Maine's Workers' Compensation Act over the last two decades, and have argued many of the leading cases decided by the Maine Supreme Court in this field. This area of law has become increasingly complex, and the rights and liabilities of the parties often differ dramatically depending on the dates of injury involved and other seemingly minor details. Our attorneys' command of the intricacies of the statutory scheme and relevant case law gives our clients the advantages of solid legal advice and respected representation.

The firm's workers' compensation lawyers are leaders in the development of innovative theories and tactics to maximize the rights of employers and insurers facing workers' compensation claims. Effective representation often begins with advice that interprets recent decisions of the Maine Supreme Court or the Workers' Compensation Board in ways that can place our clients at an advantage. Often the tactics employed at the outset of a case will result in successful litigation or a favorable settlement.

Our lawyers appear before the Workers' Compensation Board throughout the state, and primarily in the Augusta, Lewiston, and Portland regional offices. We also appear regularly before the U.S. Department of Labor in Maine and Boston to handle claims under the federal Act. We have developed a solid reputation and good working relationships with all of the hearing officers, allowing us to provide effective, efficient service to our clients. We are committed to providing our clients with the highest quality service and the most effective representation available.
